As long as the right remains uncertain, the taxable income does not materialize , preventing the beneficiary from paying taxes on capital that could still be lost.

When the agreed-upon conditions are finally met and the company relinquishes financial control, the right is then established. At that precise moment, the amount becomes taxable income , which will be taxed according to the taxpayer's profile: as employment income for directors or as business income for shareholders.

Regulatory aspects and personal income tax

To understand the legal framework, one must look at Article 14.2h of Law 35/2006 on Personal Income Tax (IRPF). The Supreme Court's view on the Wealth Tax

Recently, the Supreme Court settled a dispute regarding whether these insurance policies should be subject to Wealth Tax when there is no surrender right. Some previous rulings suggested that, even if surrender was not possible, the asset value still existed. However, the Supreme Court determined that if the policy does not recognize a surrender right , there is no Wealth Tax liability according to the original wording of the law until 2020.

The Supreme Court has ruled that a Unit Linked policy is, first and foremost, a life insurance contract, regardless of its significant savings component. As of 2021, the regulations have changed, and now the savings component is calculated based on the mathematical reserve if there is no full surrender right, aligning the legislation with the reality of these products.
